An Ohio boy who was removed from his mother’s home because he was obese is no longer under court supervision.

The boy, now 9 years old, returned to his mother’s home in Cleveland Heights in early March after he lost more than 50 pounds, the Cleveland Plain Dealer reports. He weighed 166 when he returned; he now weighs 173. On Thursday, a judge released the boy from protective supervision.

The boy lived with an uncle during the time he was away from home.

Despite the latest weight gain, the boy is exercising regularly, according to lawyer James Hardiman of the American Civil Liberties Union. Cuyahoga County Children & Family Service will continue to monitor the child for 90 days, the story says.
