When a California couple reported to police earlier this year that a stranger had shined a bright light on them in bed and abducted the woman, they were publicly accused by police of making a false report of a kidnapping.

But it now appears that the crime actually occurred, and a Harvard Law School graduate suspended from the practice of law has been accused by federal authorities of committing it. Matthew Muller is in custody on charges related to a June home invasion, but he has not been charged in the kidnapping of Denise Huskins, San Francisco Chronicle reports.

Kerr & Wagstaffe, a law firm representing the couple—Huskins and her boyfriend Aaron Quinn—has announced that it plans to file a notice of claim Thursday against the Vallejo police department, the Chronicle reports.

The action would be a first step toward filing a civil lawsuit against the city.
