As Judith Regan’s former lawyers litigate a claim that the publishing powerhouse fired them as she was about to settle a case against her former employer, to avoid paying a 25 percent contingency fee, both sides agreed to keep certain materials concerning the underlying case confidential.

But someone apparently forgot to tell the New York Supreme Court clerk’s office in Manhattan about the pact. And so material that was intended to be filed under seal in the contingent-fee dispute wound up in the ordinary case file, reports the New York Times.

Among the details revealed are that Regan reportedly settled her earlier case against News Corp., the owner of her former employer, HarperCollins, for $10.75 million. She had sought $100 million in the breach-of-contract and sex discrimination suit she filed in 2007.
