The owner of a now-famous kitty, who was assumed dead after being struck by a car and buried but returned home hungry and dehydrated, is now fighting to regain custody of his pet.

Originally named Bart, but dubbed as the “zombie cat,” the feline is being treated for his injuries at the Humane Society of Tampa Bay. But officials there have said they believe the cat will be better-off adopted into a new home once he recovers, sparking the lawsuit filed this week by his 52-year-old owner, Ellis Hutson of Tampa, reports the Tampa Bay Times.

Attorney Thomas Gonzales is representing the humane society on a pro bono basis. Hutson, as of now, is pro se.
