Passengers who spent 10 hours stuck on an unheated New York City subway train without food or water during a major 2010 snowstorm are getting paid about $250 an hour for doing so.

A settlement reached between the Metropolitan Transit Authority and 38 passengers calls for each to get a $2,500 settlement, reports the New York Daily News.

“It’s just a token of an apology from the MTA,” said attorney Aymen Aboushi, who litigated the Queens Supreme Court case pro bono. “Governments don’t apologize — they pay.”

A spokesman for the MTA said the agency considered the settlement fair to all concerned.
