Porn studio settles suit over titles taking liberties with Ben & Jerry's ice cream flavors
A pornography studio has agreed to stop selling its “Ben & Cherry’s porn series after ice cream maker Ben & Jerry’s claimed trademark infringement.
U.S. District Judge Lewis Kaplan of Manhattan approved a consent judgment in the case Monday, Reuters and Bloomberg News report.
Titles in the DVD series included Chocolate Fudge Babes, Peanut Butter D Cup and Boston Cream Thigh. Ben & Jerry’s, on the other hand, markets trademarked ice cream flavors called Chocolate Fudge Brownie, Peanut Butter Cup and Boston Cream Pie.
The deal also covers labeling and advertising. The porn company, Rodax Distributors Inc., used the slogan “Porno’s Finest” while Ben & Jerry’s used “Vermont’s finest.”
