Jailed a week ago on suspicion of first-degree murder after he called authorities to report that his wife is dead, a 23-year-old Oklahoma man has yet to be formally charged in what he calls an accidental shooting during a sex game.

Arthur Sedille says he often put a gun to his wife’s head when they were in bed together, but didn’t realize the weapon was loaded when he pulled the handgun’s slide back as they were having sex on Dec. 21, reports CNN.

Rebecca Sedille, 50, was found in their bedroom with a gunshot wound and pronounced dead at a local hospital, the Oklahoman reports.

A Canadian County judge determined that there was probable cause to hold Sedille while authorities there continue to investigate the case, and he is in the Oklahoma County jail, where suspects are routinely held. CNN reports that Master Sgt. Gary Knight of the Oklahoma City police says authorities opted to arrest Sedille on suspicion of first-degree murder due to an abundance of caution.
