Defendant wins murder trial delay after notes from his ex-lawyer wound up in prosecution file
A murder defendant successfully sought a trial delay after pointing out in a handwritten petition to a North Carolina court that notes from a lawyer who had formerly represented him wound up in a prosecution file.
Eric Cornell Wilson said in the filing that a different lawyer who subsequently represented him for a time explained to him last year what had happened with the prior defense attorney’s notes but “downplayed the issue of lawyer-client confidentiality.” District Attorney Greg Newman confirmed that the notes were inadvertently provided to the prosecution in the Henderson County Superior Court case two years ago, along with an evidence file, before he took office, according to the Asheville Citizen-Times and the Hendersonville Lightning.
The murder case will now be prosecuted by the state attorney general’s office.
Wilson is accused of strangling to death his former girlfriend, at her home, three years ago. A protective order was in place at the time.
