Lindsay Lohan’s emotional distress suit over a lyric in a song by Pitbull should be heard in federal court, according to a removal notice by the rapper’s lawyers.

Lohan had filed suit in New York state court, but Pitbull—whose real name is Armando Christian Perez—says Lohan doesn’t live there. According to the document filed on behalf of Pitbull, Lohan falsely claimed to be a resident of Nassau County, New York, despite her continuing legal obligations to the state of California.

Lohan’s Aug. 19 lawsuit claims violations of her right of publicity and intentional infliction of emotional distress. She targets the song “Give Me Everything” for this line: “I got it locked up like Lindsay Lohan.”

Courthouse News Service posted the notice of removal (PDF) and covered its assertions. Pitbull is represented by lawyers with Kasowitz, Benson, Torres & Friedman.
