Samsung Calls Apple Bid for Judgment Sanction 'Frivolous,' Federal Judge Lets Trial Roll On
Fireworks earlier this week about whether Samsung Electronics Co. had done an end run around a federal judge by providing to the media evidence excluded from a patent trial with Apple Inc. over design of the two companies’ smartphones apparently have fizzled.
After a Thursday response by Samsung that described as “frivolous at every level” Apple’s Wednesday motion that it be granted judgment on key issues as a sanction for its opponent’s public disclosure of the evidence, U.S. District Judge Lucy Koh has let the San Jose, Calif., trial roll on, Bloomberg reports.
Koh did have the jury polled to see if members had been alerted to the excluded evidence by the media (at least one had seen headlines), but allowed all to remain on the panel, the article says. She also declined to punish Samsung by granting the judgment that Apple sought.
