Award-winning actor and director Sean Penn has been charged with battery and vandalism for allegedly attacking a photographer and breaking his camera.

The October incident was captured in footage that was posted by the TMZ celebrity website, the L.A. Now blog of the Los Angeles Times reports.

“We are alleging he kicked a photographer, and we are also accusing him of breaking the photographer’s camera,” Frank Mateljan tells the newspaper. He is a spokesman for the Los Angeles city attorney’s office.

If convicted in the misdemeanor case, the 49-year-old Penn could be sentenced to as much as 18 months in jail.

The article doesn’t include any comment from Penn or his counsel.
