Settlement Requires Cigar-Smoking New Yorker to Pay His Neighbors $2K Per Stogie
A New Yorker has settled a $2 million lawsuit by agreeing to pay his neighbors $2,000 each time he smokes a cigar in his apartment.
The deal requires Harry Lysons to give his neighbors access to his apartment to sniff out any violations, according to the New York Post. More specifically, the settlement reads: “Each party hereto shall afford the other party access to their apartment, upon reasonable notice for the purpose of verifying that the plaintiffs’ apartment smells from cigar smoke which emanated from defendants’ smoking cigars in the prohibited areas.”
Lysons’ lawyer, Jeffrey Marcus, told the Post and the New York Daily News that his client won’t have to pay because he will no longer smoke at home. “They could have put in a million dollar fine and it would have been fine with us, because my client won’t be smoking any cigars in the apartment,” Marcus told the Post.
