A lawsuit filed by the son of former New York Mayor Rudolph Giuliani over his dismissal from Duke University's varsity golf team last year is in the rough, reports the New York Daily News.
Magistrate Judge Wallace Dixon has recommended that Andrew Giuliani's North Carolina federal court suit be dismissed, saying in a written opinion that the breach-of-contract claim "slices far from the fairways." A copy of the opinion was posted today on the Smoking Gun.
But Giuliani, who graduated from Duke this year and recently turned pro, is still in the game: "The case is going forward," his attorney, Bob Ekstrand, tells the newspaper. "And Andrew is an honorable, fantastic young man, and he is looking forward to his day in court."

Great opinon by Dixon. Classic. Also, Interesting that Duke hired one of the lawyers—Jim Cooney—who so sucessfully represented one of the Duke Lacrosse players (and made the Duke administration look very bad for assuming the guilt of his client).

This case hasn’t done much for law or the sport, but it sure has revived the Golf Joke.
