Suit smells something amiss with unscented deodorant

A class action lawsuit against five deodorant companies claims they are misleading consumers by labeling deodorants as “unscented” despite their discernible smell.

The suit (PDF) by lead plaintiff Melissa Fogarty of Cherry Hill, New Jersey, alleges the targeted products have “a noticeable and unmistakable scent detectible by any reasonable consumer.” Daily Finance and Top Class Actions covered the allegations.

The suit says consumers couldn’t detect the scent when purchasing the deodorant because of the packaging. The suit targets unscented deodorants sold as Arm & Hammer Essentials, Arm & Hammer UltraMax, Secret Outlast, Mitchum Men’s, Mitchum Women’s, Mitchum Men’s Clinical, Mitchum SmartSolid, Dry Idea and Ban.

Philadelphia lawyer Mark Rhoades filed the suit on Fogarty’s behalf in New Jersey federal court.
