Supreme Court Lets Stand Order Keeping Judges Out of Gitmo Transfer Decisions
The U.S. Supreme Court has let stand an order barring federal judges from ruling on the transfer of detainees from Guantanamo Bay.
SCOTUSblog says the refusal to review the federal appeals court decision is “a significant victory for the federal government, enhancing its authority to decide when and where to send detainees that are cleared for release from confinement without interference by federal judges and without challenge by detainees’ lawyers.”
The case known as Kiyemba II involves four Chinese Muslim Uighurs. The Uighurs want 30 days’ notice of where they will be sent upon release, according to the Associated Press and Bloomberg. They claim they could be killed or imprisoned if returned to China.
