Actor Wesley Snipes will stay in jail, where he is serving a three-year sentence for failing to file federal tax returns for several years, after the U.S. Supreme Court today refused to hear his appeal of his conviction on venue grounds.

Snipes argued that the feds should have brought the case somewhere other than Florida, and contended that the trial judge should have held a hearing on the venue issue before presenting the misdemeanor case to the jury, reports Reuters.

However, prosecutors pointed to the fact that Snipes was born in Florida, had a house there since 1992, had a state driver’s license and listed the state as his address in the paperwork for some of his movies.
