A tearful defense lawyer who doesn’t want her client to pay for her mistakes convinced a federal judge in Indiana to give her client more time before sentencing.

The Times of Northwest Indiana says lawyer Andrea Gambino appeared to weep in open court Thursday as she pleaded with U.S. District Judge Rudy Lozano not to take his frustrations with her poor performance out on her client.

Gary, Ind., boxing star Charles “Duke” Tanner was to be sentenced Thursday for his role in a cocaine distribution scheme, but Lozano agreed to delay the hearing when Gambino asked to be removed from the case. Judge Lozano warned Gambino that she could face sanctions for her conduct.

But when Lozano asked Tanner if he wanted to switch lawyers, he said no.

“I want to continue with her being my attorney,” Tanner is quoted saying. He reportedly added that he would rather spend more time in jail to give Gambino time to perfect his appeal.
