Texas restaurant that was site of biker shootout faces lawsuit by neighboring eatery

The Texas restaurant where nine people were killed Sunday in a confrontation between motorcycle gangs is being sued by a neighboring restaurant for loss of business.

The Don Carlos Mexican Restaurant on Thursday sued the corporate owner of the Waco Twin Peaks restaurant and its franchiser. The $1 million suit (PDF) alleges Twin Peaks owners and managers invited rival gang members to a meeting at the restaurant, disregarding “basic common sense and ordinary prudence.” The Waco Tribune-Herald and Reuters have stories.

During the shootout, patrons of the Don Carlos Mexican Restaurant across the street were trapped inside, the suit says. Afterward, the Don Carlos restaurant was among several businesses forced to close by law enforcement.

The incident has ended negotiations to sell the Don Carlos restaurant, according to the suit, which alleges negligence and gross negligence.
