Donald Trump says in a lawsuit filed on Monday that Bill Maher breached a contract when the comedian didn’t deliver on a promise made on The Tonight Show.

Maher had told Jay Leno he would pay $5 million to charity if Trump proved he was not “spawn of his mother having sex with orangutan,” report Politico and the Hollywood Reporter. Trump says in a press release that he complied with the “unconditional offer” by releasing a copy of his birth certificate.

Maher’s offer was made after Trump had asked President Obama to provide a copy of his birth certificate, and then offered to pay $5 million to charity if the president publicized his college and passport applications and records.

The Hollywood Reporter gives Trump’s suit (PDF) little chance of success since he would need to prove Maher’s statement was not merely a joke. “We’ll chip in $500 to the charity of Trump’s choice if he actually prevails in court over Maher and collects $5 million,” the publication says.
