Woman Sues Phillie Phanatic, Claims Injuries from Pool Toss

A Pennsylvania woman claims in a lawsuit that the Philadelphia Phillies mascot injured her when he tossed her in a pool while performing at a New Jersey hotel.

Suzanne Peirce claims in the suit that she was at The Golden Inn in Avalon for her sister’s wedding in July 2010 when the Philadelphia Phanatic picked up her lounge chair and tossed her and the chair into the pool. Peirce says she suffered a herniated disc and other severe injuries. Courthouse News Service posted the complaint (PDF). Reuters and the Philadelphia Daily News have stories.

The suit says the pool water was “too shallow under the circumstances” and the Phanatic failed to consider the depth.

The Daily News interviewed lawyer Aaron Denker, who said the Phanatic was not at the hotel for the wedding of Peirce’s sister.

The suit names as defendants two men who play the mascot, as well as the Phillies and the hotel. A Phillies spokeswoman told the Daily News she does not believe the mascot engaged in wrongful conduct.
