BAR/BRI Sued Again

BAR/BRI is facing another lawsuit claiming law students paid too much for the bar review course.

The $48 million class-action suit claims the company’s advertising materials fraudulently induced New York law students to overpay by about $1,000 each, the National Law Journal reports. The class includes anyone who graduated from a New York law school and bought BAR/BRI products in the last six years.

The lawyer pursuing the New York suit, Robert Arleo, objected to a recent $49 million settlement of a BAR/BRI lawsuit in California. See this ABAJournal.com post for more information.

Arleo, a solo in Haines Falls, N.Y., told the legal newspaper the bar review course is "grossly overpriced, and the manner in which they sell it has got to stop." The suit, originally filed in state court, was removed to federal court on July 17.

BAR/BRI is owned by Thomson Corp. A lawyer for the company refused to comment.

Why is it just NY law students?  More than just NY law students saw the ads for the NY BAR/BRI and paid for it.  Why shouldn’t it be NY BAR/BRI user?
BAR/BRI’s practices do need to be stopped but shouldn’t the gov’t be helping in that and who is going after Kaplan?

I’m not certain what “practices” form the basis of a complaint against BAR/BRI.  From my perspective, the NYS board of bar examiners should itself be sued for the continuation of its requirement for waiver of “five out of seven years of fulltime practice.” My position is that this requirement disproportionately impacts women who take either part-time or three quarter time work to accommodate children or who relocate for their spouse’s work.

Whats the complaint?????  No one was forced to take the course....it was offered at a price and everyone had the option to choose other study aids........we are trying to become lawyers and are now complaining that someone “charged” us to much for a review course....that we paid.....give me a break.

Just like any other commercial enterprise Bar/Bri charges what the market will bear. If you think it is too much then dont take the class.
