A Florida man facing a burglary charge is once again free on bond, after his lawyer persuaded a judge that he had seemingly violated the terms of his bond unintentionally, by drinking a cocaine-containing herbal tea.

Meanwhile, however, suspect Jerome Klein spent two months in jail in Broward County after drinking the Bolivian herbal tea prepared by his mother and subsequently failing a drug test, reports the Miami Herald.

"In May, state prosecutors said Klein's urine contained too high a concentration of cocaine to be caused by drinking tea," the newspaper recounts. "But Friday, Theodore Mastos, a former Miami-Dade County judge, convinced Circuit Judge John Murphy III that Klein was the unknowing victim of the herbal brew."
