Judge Blasts Actress for ‘Callous’ YouTube Video, Upholds Prenup

A New York judge has blasted a British actress for ranting against her husband in a YouTube video and upheld her prenuptial agreement that limited her divorce settlement to $750,000.

Judge Harold Beeler gave actress Tricia Walsh Smith a month to leave the swank New York apartment she had shared with her husband, Broadway producer Philip Smith, Reuters reports.

Beeler said Philip Smith had been “publicly humiliated to an unprecedented extent" because of his wife’s “calculated and callous campaign to embarrass and humiliate” him.

Walsh Smith told the New York Post she thought the ruling “sucked.”

In the YouTube video, Walsh Smith said she discovered her husband had horded Viagra even though they never had sex. The New York Post summarizes Beeler’s ruling this way: “Tricia Walsh-Smith finally got what she was asking for--she got screwed.”

    So is it solely a matter of upholding the prenupt contract or did she have tort claims also--invasion of privacy???

    It’s the liberal New York mentality - I don’t want to have to be stuck with what I actually bargained for, I want everything.  And if you don’t gimme gimme it, you’re a big meanine and it’s unfair.

    I watched some of these YOO-tubers. He is about 20 years older than her.  I sympathize with the old codger, but believe me, getting rid of her for $750K is a bargain.  It’s sad that older men go for younger women, but once they start to turn, it’s smart to head for the hills.  And I can understand why he didn’t have sex with her.

    Look, she was a trophy wife and she couldn’t fulfill that part of her role.  She signed the prenup, there was no question that the judge was going to uphold the agreement.

    She also claims in another newspaper that if she didn’t fight or post the video, she would have gotten only $50,000.  Read the prenup, Section 15.2(A)(1)(d) - less than 10 years of marriage equals $750,000.

    She got only what she would have got no matter what ranting and raving she did.  Probably a better strategy for her lawyers should have been to argue that Section 3.3 - claiming she is an educated person - was an error that materially affected the validity of the agreement:)

    Kay--It would be really nice if you (as a non-lawyer) would actually bother to pull up the docs and take a look before you post more nonsense.
