A New York judge has refused to dismiss a malpractice suit against Paul, Hastings, Janofsky & Walker on statute of limitations grounds.

The suit by investor Ronald Katz claims the law firm failed in its due diligence work when it represented him in connection with a $3 million investment he made in a company called Humitech, the New York Law Journal reports.

Katz claims the law firm failed to uncover that the company did not have full ownership of mineral rights he expected to obtain and stock pledged as collateral, the story reports.

Judge Doris Ling-Cohan said she needed more information about how long the firm represented Katz before she could determine whether the suit was time-barred.
