N.J. Partner Sues Firm for Age Bias, Partner Payout

A 52-year-old partner has sued his former New Jersey law firm for age discrimination.
James Toll claims in his suit that he was forced out of Sills Cummis & Gross because of his age and a perceived disability because of a 1997 heart attack, the New Jersey Law Journal reports. Toll alleges he can sue under age bias laws that protect employees because he had no say in the firm's governance.
The suit also seeks the fair value of his interest in the firm under the state’s Oppressed Minority Shareholder Statute.
The lawyer handling the firm’s defense says Toll’s ouster was because of its decision to focus on representing big corporations, a practice that was incompatible with Toll’s personal injury practice.
