Plaintiff Ends Suit Over Bar Exam Question

A federal court battle over a bar exam question on gay marriage has ended with the plaintiff agreeing to dismiss the case.
A Massachusetts federal judge granted the plaintiff’s motion to dismiss the case on Monday, the National Law Journal reports.
Plaintiff Stephen Dunne had contended he failed the Massachusetts bar exam because he objected to the question and didn’t answer it. He noted the question was not on the July 26 bar exam in a motion to voluntarily dismiss the case.
"Defendants' removal of the question is assurance that all future examinees taking the Massachusetts Bar Examination will not be forced to accept, support or promote a liberal ideology on a professional licensing examination," he wrote.
But bar officials say the question was a legitimate one about the state of the law, and they retain the right to test bar applicants on the subject in future exams.
