Pot Misinformation Suit Tossed

A federal judge has tossed out a lawsuit claiming the federal government is lying about marijuana.

Americans for Safe Access had claimed the federal Information Quality Act requires the Drug Enforcement Administration to refute claims that the drug has no accepted medical use. (See this ABAJournal.com post for more details.)

But Judge William Alsup of San Francisco said the federal law provides for administrative rather than judicial review of claims, the Recorder reports. He suggested federal courts may be able to rule on a more limited suit that seeks to force the government to address a complaint within 60 days, the deadline set in the federal law.

His order last Tuesday gives the group leave to amend its complaint.
