A Spanish judge indicted three U.S. soldiers today over the 2003 death of a Spanish journalist killed by tank fire while staying in a Baghdad hotel.
The three were charged with homicide and "a crime against the international community," which under Spanish law is defined as an indiscriminate or excessive wartime attack on civilians, reports AP.
A U.S. review of the controversial incident soon afterward determined that the decision to fire on the occupied hotel, after an American allegedly drew hostile fire from the hotel, was justified, according to then-Secretary of State Colin Powell. The U.S. has reportedly made clear that it will not hand over the three soldiers to Spanish authorities for prosecution.
