Sprinkles Sues Cupcake Competitor Over Candy Dot

Sprinkles has sued over its candy dot.

The three-year-old Beverly Hills bakery, a favorite of Oprah Winfrey and Paris Hilton, says a six-month-old West Hollywood competitor, Famous Cupcakes, has stolen its signature trademark. Although the defendant company apparently isn't actually using a color-coded circular piece of candy atop its cupcakes, which Sprinkles does to distinguish a Red Velvet from a Chai Latte, among other flavors, it is using a motif of dots on its store, packaging and website, reports the Los Angeles Times.

The suit contends that what it refers to as a "modern dot" design misappropriated by Famous Cupcakes infringes on Sprinkles' trademark, the newspaper says.

Owner Desiree Adl says she got a letter a while back from Sprinkles, but didn't pay much attention because her bakery doesn't put dots on its cupcakes. "You put their cupcakes with our cupcakes, everyone knows which one is Sprinkles," she says.
