Suit Claims Phillips & Cohen Failed to Pursue Whistle-Blower Case

A malpractice suit claims Washington, D.C.-based law firm Phillips & Cohen failed to pursue a whistle-blower case against a contractor for a Massachusetts highway project.

The plaintiff says he didn’t realize he suffered damages from the law firm’s lack of action until September 2006; the law firm claims the statute of limitations bars the suit, the National Law Journal (sub. req.) reports.

Peter Krupp of Boston is representing Phillips & Cohen in the lawsuit, filed in federal court in Boston. He told the National Law Journal that the plaintiff "disappeared for four years" after contacting the law firm in 2000 and never provided information so the firm could pursue the whistle-blower claim.

"I just don't see on the merits or procedurally how there's any claim at all," Krupp told the publication.
