Thelen Says Malpractice Plaintiff Waived Any Conflict, Seeks Unpaid Fees

Thelen Reid Brown Raysman & Steiner says in a response to a malpractice suit that the plaintiff waived any alleged conflicts of interest.

The response also says the plaintiff or third parties contributed to alleged losses, and the suit was time-barred, the Recorder reports. The law firm has also counterclaimed for $120,000 in unpaid legal fees.

The June lawsuit filed by IVI Smart Technologies Inc. and two subsidiaries claims Thelen helped transfer the plaintiffs’ intellectual property for fingerprint verification technology to another client of the firm. The malpractice complaint alleges Thelen agreed to represent one of the subsidiaries without disclosing that it had represented the other client, a competitor, twice before.
