Vioxx Ruling Expected to Favor Merck

A Texas judge is expected to dismiss a Vioxx case on Monday, an action that could affect 1,000 cases filed against the painkiller’s manufacturer in the state, the Wall Street Journal reports.

Judge Randy Wilson told attorneys he will suspend all Vioxx cases in the state until an appellate court reviews his dismissal, the newspaper reports. Wilson is expected to hold that a Food and Drug Administration rule governing warnings on health-care products pre-empts state law.

Merck & Co. faces some 28,000 lawsuits nationwide involving allegations that Vioxx causes heart attacks and strokes.
