Vonage Holdings is citing the U.S. Supreme Court’s recent patent ruling in a motion seeking a retrial of a patent infringement case.

Vonage filed the motion with the U.S. Court of Appeals for the Federal Circuit in Washington on Tuesday, according to Bloomberg News.

The Supreme Court's Monday ruling in KSR International Co. v. Teleflex Inc. made it easier to invalidate patents for obvious inventions. The Vonage jury was instructed based on the old, improper test, the motion says, according to CNET News.

A jury had ruled in the Vonage case that the Internet phone company had infringed three patents held by Verizon Communications.

The Wall Street Journal (sub. req.) posted the motion. Its story notes that Vonage has also mounted a public relations campaign suggesting that Verizon wants to suppress competition.
