A New York judge has excluded a fashion writer’s incendiary statements to a detective from evidence in his upcoming criminal trial for a sexual attack on an editor on Halloween 2005.

Peter Braunstein called his father a “media whore” for speaking to the press and asked an officer if the victim had a book contract.

Justice Thomas Farber ruled yesterday that the statements were made in violation of Braunstein’s right to a lawyer, according to the New York Times.

The defense contends Braunstein could not form an intent to commit the crime because of a brain disorder.
