Court Says Sperm Donor Owes Child Support

In what reportedly could be the first such ruling in the nation, a Pennsylvania court has found a sperm donor responsible for supporting his two biological children.

The situation is complicated by the fact that the sperm donor died suddenly earlier this year, notes an AP article on the Superior Court ruling in Dauphin County. It reports that Carl Frampton Jr. donated sperm to a lesbian couple he knew, so that they could have two children during their decade-long relationship.

The two women reportedly may have entered into a civil union in Vermont, but the article does not say whether there was any effort to document the sperm donor agreement in a contract or other legal documents.

Standard sperm donor procedures, when fertility clinics are involved in stranger-to-stranger donations, include release agreements and other contractual documents intended to prevent subsequent paternity and child support disputes among those involved.
