Did couple in their mid-90s have the right to marry? One spouse is legally incapacitated

Edith Hill, 96, and Eddie Harrison, 95, are newlyweds who are very much in love, according to Hill’s granddaughter, Robin Wright.

“You catch them kissing all the time,” Robin Wright said of the happy Virginia couple, in an interview with the Associated Press. She and her mother help care for the couple, the story says. But the marriage has been challenged because Hill has been declared legally incapacitated.

Judge James Clark of Alexandria said last month the marriage may not be legally binding and appointed Hill’s lawyer, Jessica Niesen, to investigate and act to protect Hill’s interests, according to Reuters and AP.

Niesen told AP she thinks she would like the marriage to continue. But there are legal questions about inheritance and where the couple will live. She thinks a postnuptial agreement could prevent Harrison from inheriting Hill’s estate.

The judge appointed Niesen as Hill’s guardian, replacing the co-guardians. AP identifies the co-guardians as Rebecca Wright, Hill’s daughter, and Wright’s sister, Patricia Barber. But Reuters says Rebecca Wright is Hill’s granddaughter, and she is co-guardian with Barber. Both stories say Barber challenged the marriage.

According to AP, Rebecca Wright took the couple to get married.
