Lawyer now says he won't pursue $252.25 demand for missing soup at lunch

A Texas lawyer has backed down after demanding $252.25 from a Mansfield diner because his lunch special came without a cup of soup.

If he had it to do over again, attorney Dwain Downing told WFAA on Monday, he wouldn’t have written the letter he sent to Our Place Restaurant last week because of the firestorm it created after the diner owner put it on Facebook. Downing also says he no longer intends to pursue the lawsuit he threatened in the letter.

“I didn’t put it on social media,” he told the station, referring to the letter. “I didn’t intend for it to become this way. This place was rude, very rude. He put it on social media. Cyberbullies have threatened my life.”

Owner Benji Arslanovksi said regulars understand that the diner’s homemade soup is available only for a limited time.

“The soup is great, people love it,” he said Friday. “But it’s only while it lasts for that day.”
