Warned not to drive home after DWI conviction, man does and is charged with drunken driving
A New York man who reportedly smelled of alcohol when he was convicted Monday of driving while intoxicated was told by the judge, his lawyer and an Erie County sheriff’s deputy not to drive home from the Grand Island Town Court hearing.
However, J.B. Silverthorn, 44, nonetheless got behind the wheel. Deputy Simon Biegasiewicz, who had warned Silverthorn not to drive, left the court shortly after Silverthorn did, spotted him exiting the courthouse parking lot and pulled him over, according to the Associated Press and the Buffalo News.
Silverthorn was again charged with driving while intoxicated, but this time is facing a felony case because of his prior conviction.
