Pass List May Not Be Final for July '07 N.Y. Bar Exam
A “fail” may not be the final answer for some individuals who took the New York bar exam in July.
If they were among those who failed the exam because of apparent software glitches that prevented some answers on computer laptops from being saved, a successful appeal may be possible, according to the New York Personal Injury Law Blog.
Although the appeal process apparently has not been publicized, “the New York State Board of Law Examiners has confirmed to me that they will hear appeals regarding the July 2007 exam” under such circumstances, writes blogger Eric Turkewitz. The blog post includes a lengthy personal account from an examinee who says two of his answers apparently were garbled or at least partially lost before he switched midexam from using his laptop to handwriting answers.
As discussed in an earlier ABAJournal.com post, New York bar exam officials say answers for 47 examinees were lost as a result of the software glitch.
However, the blog post today suggests that more examinees may possibly be affected by the problem. It also indicates that a number of examinees who believed they failed the bar exam because of software issues may be appealing, although the appeal option apparently has not been publicized.
