Doggie Death Sentence Appealed

Lawyers arguing over the fate of a bit bull named Duke filed papers with a New York state appeals court yesterday.

Duke has been on “doggie death row” for more than three years, the New York Times reports.

“We are running out of options,” says Amy Chaitoff, the lawyer for Duke’s owners. “And it would be a terrible injustice.”

After Duke reportedly attacked two neighboring dogs, a judge ordered Duke euthanized under a 2004 state law aimed at cracking down on dogs that bite other dogs.

In the past 10 years, about a dozen states passed laws that authorize euthanasia for dogs in such cases, the newspaper says.
