A Memphis, Tenn., drug defendant was reluctant to accept a judge’s offer of freedom on Monday, citing concerns that he has nothing to wear.

The judge ordered defendant Thorne Peters released on his own recognizance after prosecutors dropped a felony drug charge against the nightclub owner, leaving in place only misdemeanor marijuana charges. Peters, who was dressed in jail garb, wasn’t happy with the news, according to the Memphis Commercial Appeal.

“You’re sending me into the snow with a tank top and pajama bottoms?” Peters shouted at the judge. As Peters continued to protest, the judge ordered him removed from the courtroom, the story says.

“Have you held me in contempt of court yet?” Peters asked. When the judge said he had not, Peters replied, “OK. Get ready to, because I’ll be back.”
