Lawyers for Colo. Shooting Suspect Won't Pursue Sanctions for Mug Shot Release

Lawyers for Colorado shooting suspect James Holmes have given up their quest for sanctions over the release of a second mug shot.

The lawyers had argued that the Arapaho County Sheriff’s office leaked the photo to the press in violation of an order limiting pretrial publicity, according to the Denver Westword blog the Latest Word.

Holmes no longer sports orange hair in the new mug shot, but he has a wide-eyed expression. The Latest Word characterizes the photo as “strange.”

Sheriff Grayson Robinson told the Latest Word that the department took the second mug shot because Holmes’ appearance had changed and it was needed for security reasons. He released the photo, he said, in response to a media request.

A court filing by the defense said that, based on conversations with the sheriff’s office, it was no longer requesting sanctions of a hearing on the issue.

Holmes is accused of killing 12 people and wounding more than 50 others during a showing of the new Batman movie.
