No Charges Likely for Kaye Scholer Partner Who Ousted Kids from Car

The Kaye Scholer bankruptcy partner who made headlines when she kicked her squabbling kids out of the car probably won’t be charged with child endangerment.

The charge against lawyer Madlyn Primoff will be dismissed if she stays out of trouble for six months, according to reports in the Associated Press, the New York Daily News and the Westchester County Journal News.

“There is no ongoing danger to the children,” Westchester County, N.Y., Assistant District Attorney Audrey Stone told a judge at a hearing today, according to the Journal News. City Court Judge Eric Press of White Plains said he will dismiss and seal the case on Nov. 9 if Primoff remains on good behavior.

Primoff’s lawyer says she drove around the block after kicking her daughters, ages 10 and 12, out of the car last month. When Primoff returned, the girls were gone. A passerby had found the younger child and turned her over to police. Primoff found the older girl later as she was walking home.

Primoff spoke to reporters after the hearing, with her husband, Richard, by her side. “Clearly, I made a mistake,” Primoff said. “But I truly love our children and I know that I am a good parent.”

Stone said Primoff is engaged in family therapy. An order of protection bars any criminal activity toward the children, AP says.
