The owner of a Buffalo, N.Y., pizzeria was found to have wrongly withheld more than $100,000 in sales taxes over a four-year period.

Joseph J. Jacobbi was spared a prison term of up to seven years, the Buffalo News reported, but he must pay back what he owes and, starting tonight, bring 12 sheet pizzas to the City Mission every Tuesday for a year.

“I will leave the choice of toppings up to you,” State Supreme Court Justice Russell P. Buscaglia told Casa-Di-Pizza owner Monday.

Court officials told the Buffalo News that the judge felt that this particular penalty would be a good way to directly help the city’s increasing number of out-of-work and homeless residents.
