Man is indicted in shooting of federal judge outside his Detroit home

A suspect has been indicted in the shooting of U.S. District Judge Terrence Berg outside his Detroit home earlier this year.

Kevin Andre Smith Jr. faces charges including armed robbery and assault with intent to commit murder in an indictment unsealed Monday, MLive.com reports.

Another man also is a suspect, but he has not been publicly identified. Berg was shot in the leg one evening last March after resisting an effort by two men to get into his home as he was returning from taking out the garbage.

“The second defendant will not be named at this time, as he is a cooperating witness with an agreement for special consideration,” said Wayne County prosecutor Kym Worthy in a written statement. “He has resolved two outstanding armed robbery cases; a sentencing hearing is pending.”

Smith was indicted by an unusual one-person grand jury. The procedure is sometimes used to prevent sensitive information that could put individuals in danger from being made public, the article notes.
