A 31-year-old Florida woman who said she was shot by her 4-year-old son as the two were riding in a pickup truck could face a criminal case.

The Putnam County sheriff’s office has recommended that a misdemeanor charge of allowing a minor to have access to a gun be pursued against Jamie Gilt, the Gainesville Sun reports. However, prosecutors have not yet determined whether to pursue the potential case.

A gun rights advocate who had posted on Facebook the previous day about how her son “gets jacked up to target shoot with the .22,” Gilt was shot in the back, through the driver’s seat, with a .45-caliber handgun.

The sheriff’s office said she had placed the gun under the driver’s seat, but it slid back to near where her son was seated. The boy unbuckled his seat belt, picked it up and shot her.
