A New York City police officer shot in the line of duty while subduing a suspect last year has sued his employer, contending that officials knew about a design defect in his bulletproof vest that allowed a bullet to enter under his arm but did not supply him with an upgraded vest as promised, reports the New York Post.

Rodney Lewis alleges common-law negligence and failure to comply with duties imposed by municipal and state law in the complaint (PDF) he filed in the New York Supreme Court in Queens.

A city Law Department spokeswoman says officials will review the complaint when they receive it.
