Fla. Couple’s Suit over Anonymous Claim of Affair Part of Textual Harassment Litigation Trend

A Florida couple is seeking the identity of a person who sent an anonymous text message claiming the husband was having an affair with one of his employees.

Their suit claiming defamation and intentional infliction of emotional distress is part of growing trend of litigation involving “textual harassment,” the Naples Daily News reports. The story cites several instances in which text messages supported plaintiffs who alleged sexual harassment.

The Feb. 28 suit (PDF posted by the Naples Daily News) claims that Lori Ann Crawford received the text message on Jan. 11, when she was celebrating her birthday. Crawford’s husband, Richard Crawford, is “a multimillionaire entrepreneur,” according to the Naples Daily News.

The text was “so outrageous in character, and so extreme in degree, that it is considered atrocious and utterly intolerable in a civilized community,” the complaint alleges.
