'Flippant, Cagey and Cavalier' Take on Accounts, 'Spiteful' Attitude Doom Lawyer's Reinstatement

It wasn’t any one thing. But a series of attorney discipline and ethics issues, over a period of decades, as well as a Michigan lawyer’s bad attitude persuaded the state Attorney Discipline Board last week to revoke his recent reinstatement to practice.

Robert L. Wiggins, Jr. had also articulated a “flippant, cagey and cavalier” approach to accounts he was in charge of and had demonstrated a “spiteful” attitude to clients, the board said in a written opinion (PDF) last week.

Noting that Wiggins had the burden to show, by clear and convincing evidence, that he is fit to practice law and finding that he hadn’t done so, the board reversed a prior reinstatement order by a divided panel.
