A judge has ordered a Brooklyn hospital to keep a 2-year-old girl on life support as he decides a dispute between her mother and father about whether her organs should be donated.

The girl, Thaiya Spruill-Smith, was declared brain-dead Friday, the New York Times (reg. req.) reports.

Her stepfather, David Adams, 25, has been accused of causing brain injuries by violently shaking her and has been charged with assault.

Her mother, Teoka Spruill wants the girl’s organs donated, Her father, Terrell Smith, says his daughter is still alive and that he is upset that his concerns about possible child abuse and efforts to get custody were not taken more seriously.

Dr. Stephan A. Mayer, who serves as director of the Institute for Critical Care Medicine at the Icahn School of Medicine at Mount Sinai, said health care facilities look to all parties to agree. “When it comes to donating organs, you need consensus,” he told the newspaper.
